PENALTIES:Delagarza pled guilty and was sentenced to 100 days in the Harris County Jail.

Delagarza was involved in a major accident on the freeway. Officers arrived and observed Delagarza to appear confused and disoriented. He had a strong odor of alcoholic beverage on his breath and was uncooperative. Delagarza was transported to the hospital with apparent minor injuries. After being released a short time later, Delagarza was transported by officers to the Central Intox Facility where he refused to provide a breath or blood specimen. A search warrant was drafted and signed by a judge allowing officers to obtain a blood specimen. Delagarza resisted officers attempts to obtain the court ordered blood specimen and was restrained in a chair. The blood specimen was taken and Delagarza was charges with DWI (second offense) and Resisting Search.
Delagarza’s blood was tested for alcohol and drugs. Delagarza’s BAC was .042. Along with the alcohol, Delagarza had a combination of Cocaine, Marijuana and Xanaxin his body.

George was observed in his vehicle parked on the wrong side of the street. As an officer pulled up behind his vehicle, George pulled away from his parking spot. As George drove down the street, he was unable to drive within a single lane and was swerving as he overcorrected to stay in his lane. When George was stopped, the officer made contact with him and George had a strong odor of alcoholic beverage on his breath, droopy eyes and slurred speech. The officer conducted Field Sobriety Tests at the scene and placed George in custody. George was taken to the Central Intox Facility where be blew 0.20.
